Terms and Conditions

These terms of use (the "Terms") govern the use of the ZAGA mobile app and the zaga.rs website (together: the "Service"), provided by Marijana Zagorac, Žabalj, Republic of Serbia, contact: support@zaga.rs ("ZAGA", "we"). By accessing or using the Service you accept these Terms. If you do not agree with them, do not use the Service.

ZAGA is a platform that allows users to post listings for clothing, footwear and fashion accessories (second-hand items, vintage pieces and local design), to browse the offer, communicate with each other, review each other and arrange purchases. ZAGA is solely an intermediary providing a space for listing and communication — ZAGA is not the seller, the buyer, nor a party to any transaction between users.

The Service may be used only by persons aged 18 or over with full legal capacity. By registering you confirm that you meet this requirement. One person may hold only one account.

Most features require an account (created with email and password, or by signing in with a Google or Apple account). You agree to:

• provide accurate and complete information when registering and using the Service, and to keep it up to date;

• keep your login credentials confidential and not share your account with others;

• notify us immediately at support@zaga.rs if you suspect unauthorized use of your account.

You are responsible for all activity carried out through your account.

By posting a listing you warrant that the item is your property and that you have the right to sell it. Listings must:

• describe the item truthfully and accurately (condition, size, defects) and contain real photos of the item being sold;

• belong to the Service's categories (clothing, footwear, fashion accessories);

• carry a genuine price; displayed discounts are based on the listing's actual price history.

It is prohibited to list:

• counterfeits, replicas and items that infringe third-party trademarks or other intellectual property rights;

• stolen items and items whose sale is not permitted by law;

• items you do not possess or cannot deliver.

It is prohibited to post content that is unlawful, misleading, offensive, threatening, discriminatory, pornographic or that violates the rights of third parties. ZAGA may remove any listing or content that violates these Terms.

When using the Service, it is prohibited to:

• mislead other users, or commit or attempt fraud;

• send malicious or phishing links, ask other users for payment card details or login credentials, impersonate ZAGA or payment services, or engage in other fraudulent practices in communication;

• harass, threaten or insult other users;

• send unsolicited or bulk messages (spam) or misuse communication beyond the purpose of buying and selling;

• impersonate others or act in someone else's name;

• manipulate reviews, ratings or the display of discounts;

• automatically extract content (scraping), attempt unauthorized access, or interfere with the operation of the Service in any way;

• use the Service for unlawful purposes.

Transactions are concluded exclusively and directly between the buyer and the seller. ZAGA does not process payments, does not arrange delivery and does not hold users' funds — users agree on the method of payment, pickup or shipping themselves, at their own responsibility.

ZAGA does not guarantee the accuracy of listings, nor the quality, safety, authenticity or legality of items, nor the seller's ability to sell or the buyer's ability to pay. Any disputes arising from a transaction are resolved by the users themselves; ZAGA is not a party to those disputes and is not obliged to mediate in them.

We recommend caution: inspect the item before paying where possible, use verifiable payment methods, and do not share sensitive information outside the app.

If you sell items in the course of a registered business activity, you alone are responsible for meeting your legal obligations towards buyers and the authorities (issuing receipts, taxes, consumer rights, conformity and complaints).

Reviews must be truthful and based on a real experience related to a specific listing. Posting fake reviews, coordinated rating to artificially raise or lower a score, and conditioning a transaction on a review are prohibited. ZAGA may remove reviews that violate these Terms.

The Service allows reporting of users, listings and reviews, with the option of attaching evidence. We review reports and act on them without undue delay. There is no tolerance for content that violates these Terms or for users who violate them — ZAGA may, at its own discretion, remove content, temporarily restrict an account, disable sign-in to an account or permanently remove an account, with or without notice where justified by the protection of other users.

Any user may block another user; a block disables communication between them in both directions.

The content you post (photos, descriptions, messages, reviews) remains yours. By posting it you grant ZAGA a non-exclusive, territorially unlimited, royalty-free licence to store, reproduce, display and make that content available within the Service and its promotion (including listing share links), until you remove the content or your account ceases to exist. Exceptionally, small previews of a deleted listing's photos may remain available to the participants of existing conversations about that listing, and the listing's basic details (e.g. its title) may remain displayed alongside reviews related to it, in accordance with the Privacy Policy.

The Service, its design, software, logo and the ZAGA name are protected by intellectual property rights and may not be used without our prior consent.

The processing of personal data is governed by the Privacy Policy, available in the app and at zaga.rs, which forms an integral part of these Terms.

You may delete your account at any time in the app (Settings → Delete account) or by request to support@zaga.rs; deletion permanently removes your data in accordance with the Privacy Policy. ZAGA may restrict, suspend or terminate an account that violates these Terms or the law, and may discontinue the Service as a whole with reasonable prior notice.

The Service is provided "as is" and "as available". We do not guarantee that the Service will operate uninterrupted or error-free, or that it will meet all your needs. Occasional interruptions due to maintenance, technical issues or circumstances beyond our control are possible.

To the maximum extent permitted by mandatory law, ZAGA is not liable for damage arising from relationships between users (including purchase, payment and delivery), from content posted by users, or for indirect or consequential damage arising from the use of, or inability to use, the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, nor does it affect rights that users have under mandatory consumer protection regulations.

If third parties raise claims against ZAGA because your use of the Service violated these Terms or the law (e.g. due to content you posted or items you sold), you are obliged to compensate us for the justified costs and damage arising from that.

We may amend these Terms, for example due to changes in the Service's functionality or in regulations. We will notify you of material changes through the app or by email at least 15 days before they take effect, unless earlier application is necessary to comply with the law or to protect the security of the Service and its users. Continued use of the Service after the changes take effect constitutes acceptance of the amended Terms; if you do not agree with the changes, you may stop using the Service and delete your account.

These Terms are governed by the law of the Republic of Serbia. Disputes fall under the jurisdiction of the competent court in Novi Sad, provided that consumers retain the right to judicial protection before the court determined by mandatory regulations.

If any provision of these Terms is found invalid or unenforceable, this does not affect the validity of the remaining provisions. These Terms, together with the Privacy Policy, constitute the entire agreement between you and ZAGA regarding the use of the Service. In case of any discrepancy between the Serbian and English versions, the Serbian version prevails.
